JUSTICE SUDHIR SINGH ORAL ORDER 21-05-2015 The petitioner is apprehending his arrest in connection with Thakurganj P.S. Case No. 133 of 2013 for the offences instituted under Sections 409 and 467 of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that one Rajendra Prasad Uraon was Head Master of Upgraded Middle School, Darjibhitththa and he during the financial year 2011-2012 illegally withdrew an amount of Rs. 8,67,000/- which was allotted for construction of 3 additional class rooms but the construction work did not commence and he withdrew the said amount leaving only Rs.14,923/- in the concerned Bank Account.

It has been submitted on behalf of the petitioner that the petitioner is a government employee and is a teacher. Further it

Further it has been submitted that the petitioner is ready to deposit amount of Rs. 50,000/- in the court below which shall be subject to final disposal of the case. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. and specific allegation of withdrawal of amount of Rs. 8,00,000/- and odd has been alleged against him.

Considering the fact that the petitioner is ready to deposit amount of Rs. 50,000/- in the court below which shall be subject to final disposal of the present case, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today in connection with Thakurganj P.S. Case No. 133 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M.
