JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 04-09-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Ms. Suman Kumari Singh, learned A.P.P. for the State. Petitioner in the present case is seeking regular bail in connection with Routa P.S. Case No. 65 of 2019 (Sessions Trial No. 68 of 2020) registered for the offence punishable under Section 302, 201, 120B/34 of the Indian Penal Code. He is in custody since 07.07.2019.

Earlier the prayer for bail of the petitioner was rejected by a learned coordinate Bench of this Court in Cr. Misc. No. 6037 of 2020.

Patna High Court CR. MISC. No.13569 of 2021(3) dt.04-09-2021 2/2 This Court has called for a report from the learned trial court as to the present stage of the trial and the time likely to be taken in conclusion thereof.

It has been informed that out of eight witnesses, four witnesses have been examined so far but due to surge of second wave of pandemic Covid-19 rest witnesses could not be produced by the prosecution.

The trial court to conclude the trial within four months after resumption of normal functioning of the court. Now the courts are functioning in hybrid mode, therefore, it is expected that the learned trial court shall fix this case on the date fixed for physical mode and all endeavours shall be made to conclude the trial within the given period of four months. At this stage, this Court is not inclined to release the petitioner on bail.
