The petitioner is languishing in custody since 08.10.2014 in a case registered for the offences punishable under Sections 376/511/34 of the Indian Penal Code. The accusation is of attempting to establish forceful physical relationship after entering into the hutment when the informant and her sisters were sleeping.
It is submitted by learned counsel for the petitioner that for the occurrence of 30.01.2014 the complaint was filed on 22.02.2014 which came to be registered as police case on 02.03.2014. The informant and her sisters were not subjected to any medical examination.
Patna High Court Cr.Misc. No.3583 of 2015 (02) dt.28-01-2015 2/2 A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 45 of 2014.
