In this case, the petitioner is seeking regular bail in connection with Kamtaul P.S. Case No. 268 of 2021, registered for the offences punishable under Sections 363, 366 of the Indian Penal Code.

As per allegation, the petitioner kidnapped the daughter of the informant aged about 21 years. The learned counsel for the petitioner has submitted that the entire allegation is false. As a matter of fact, the petitioner and the victim are in love and affairs and they had solemnized their marriage. The xerox copy of marriage certificate has been annexed as annexure-3. He has submitted further that the petitioner and the alleged victim girl were residing in Punjab and there was threatening on her life and personal liberty at the hands of her parents. The victim herself filed C.R.W.P No. 169 of 2022 in Punjab and Haryana High court and State Government of Punjab and Haryana was

Patna High Court CR. MISC. No.3269 of 2023(2) dt.07-04-2023 2/2 directed to dispose of the representation of the victim within a period of one week.

The learned counsel for the informant has submitted that when the informant perceived the real fact, he filed a compromise petition. The petitioner is under custody since 11.11.2022.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Darbhanga in connection with Kamtaul P.S. Case No. 268 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
