In this case, the petitioner is seeking bail in connection with Manjhi P.S. Case No. 166 of 2015 registered for offence under section 25(1-b)a of the Arms Act where the allegation has been made that the informant received the sound of the fire, reached the place of occurrence and there the informant could know about the incident that had taken place where allegation has been made that the petitioner used the fire arms, sustained injury in the abdomen and hand of his wife, Silpi Devi and when Renu Devi came forward to save her, she was also sustained injury in her hand.
The Police instituted two cases, one is under the
Patna High Court Cr.Misc. No.6470 of 2016 (2) dt.01-03-2016 2/2 Arms Act and another is under sections 307/302 I.P.C. This Court is only considering the case with regard to the Arms Act.
The counsel for the petitioner submits that with regard to the case in which the victim received injury and later on, died which has been dismissed with certain observation. The petitioner is in custody since 7th August 2015. This matter relates to only Arms Act though it has a direct nexus with the other cases where the victim died. Looking to the period of custody, in the present case only, the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth Saran at Chapra in connection with Manjhi P.S. Case No. 166 of 2015. (Shivaji Pandey, J) Mahesh/- U T
