The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Raniganj P.S. Case No. 321 of 2018 (G.R. No. 3131 of 2018), registered for the offence punishable under sections 420, 406, 467, 468, 471 and 120B of the Indian Penal Code. As per allegation in the FIR, the Circle Officer in collusion with the petitioner, the Circle Inspector, Bara Babu and Ram Lal Mandal recorded sikmi right in a proceeding under section 48B of the Bihar Tenancy Act.

It is submitted by learned counsel for the petitioner that in case the informant was affected by any order passed by the Circle Officer, he should have pursued the same in a civil

Patna High Court CR. MISC. No.2205 of 2020(2) dt.27-02-2020 2/2 proceeding. It is further submitted that the petitioner has no criminal antecedent and co-accused Vishwanath Singh as also Ram Lal Mandal have been enlarged on bail vide order dated 17.12.2018 passed in Cr. Misc. No. 75438 of 2018 and order dated 16.10.2019 passed in Cr. Misc. No. 61420 of 2019. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of six weeks from today and in the event of her arrest or surrender in connection with Raniganj P.S. Case no. 321 of 2018 (G.R. No. 3131 of 2018), he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria subject to the condition as laid down under section 438(2) of the Cr.P.C.
