JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-12-2022 The present writ petition has been filed seeking the following reliefs:- 1.(i) To issue a writ of certiorari for quashing the order of cancellation of Caste Certificate of the petitioner of Extremely Backward Caste (EBC) fell under EBC-1 category namely Dangi passed by the Circle Officer, Lakadi Naviganj, District-Siwan as well as the Block Development Officer, Baikunthpur also cancelled the nomination application of the petitioner for the election of Ward Member in
Patna High Court CWJC No.1011 of 2022(2) dt.12-12-2022 2/2 Pachayat Election, 2021 on the basis of Caste Certificate.
(ii) To issue a writ in the nature of writ of mandamus for direction to the respondents to issue a fresh caste certificate of Dangi Caste EBC-1 which comes under the Extremely Backward Caste."
At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Bihar State Caste Scrutiny Committee challenging the aforesaid action of the Circle Officer, Lakadi Naviganj, District-Siwan, whereby and whereunder the caste certificate of the petitioner has been cancelled. Liberty so sought is granted.
The writ petition stands disposed off.
