2. For the reasons stated in the application and
Patna High Court MJC No.76 of 2023(3) dt.24-06-2023 2/2 affidavit, even though sufficient cause of action has not been shown but in the interest of litigant, delay of one year seven days is condoned. I.A. for condonation of delay stands allowed.
3. Heard MJC No. 76 of 2023.
4. For the reasons stated in the application and affidavit, order dated 19.12.2019 passed in LPA No. 712 of 2018 arising out of CWJC No. 14648 of 2008 stands set aside and LPA No. 712 of 2018 stands restored, subject to payment of cost of Rs. 2,000/- (Rupees Two Thousand). Cost shall be remitted in the Patna High Court Legal Services Committee within a period of four weeks.
5. Registry is hereby directed to list LPA No. 712 of 2018 before Roster Bench.
