JUSTICE SHIVAJI PANDEY ORAL ORDER 01-03-2017 Heard learned counsel appearing for the parties. This Court vide order dated 19.12.2016 has recorded that the petitioner is ready to deposit 10% of the Certificate amount.
In this case, the petitioner is seeking extension of time to deposit the aforesaid amount. The ground has been assigned that he had fallen from the roof of the house and on that account he is ailing.
Patna High Court MJC No.300 of 2017 (2) dt.01-03-2017 2/2 Today, learned counsel for the petitioner has produced two Bank Drafts; one of Vijay Bank and another of Bank of India, each amounting to Rs.50,000/- before this Court. Let the Deputy Chief of Claims, Bihar State Food and Civil Supplies Corporation receive Rs.1,00,000/- which is in two Bank Drafts. The petitioner shall tender the aforesaid drafts before the authority by tomorrow.
Ten weeks' further time is granted to the petitioner to deposit the rest 10% of the certificate amount. If the petitioner would fail to deposit the aforesaid amount within ten weeks', then the interim relief which has been granted to the petitioner will be treated to have been withdrawn. It is clarified that no further time will be granted to the petitioner in future. Accordingly, this application is disposed of. (Shivaji Pandey, J) pawan/- U
