The petitioner seeks bail in connection with Bhagwan Bazar P.S. Case No. 357 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.07.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the allegation is of recovery of 100 litres of liquor from a tempo. Learned counsel for the petitioner submits that the petitioner was arrested from the tempo but he is neither the owner nor the driver of the tempo rather was a passenger and as such was not knowing what was loaded in the tempo.

Patna High Court CR. MISC. No.3934 of 2022(2) dt.07-03-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-2ndcum-Special Judge, Excise, Saran at Chhapra in connection with Bhagwan Bazar P.S. Case No. 357 of 2021.
