JUSTICE RAKESH KUMAR ORAL ORDER 11-04-2016 Heard Sri Umesh Chandra Verma, learned counsel, who was assisted by Sri Abhishek Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 04.01.2016 in Muffasil P.S. Case no.185 of 2014 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner and his entire family members have been falsely implicated by the informant side due to the reason that the petitioner was earlier the informant in a case i.e. Muffasil P.S. Case no. 127 of 2013 registered for the offence under Section 302, 120(B) of the Indian Penal Code, in which brother of the petitioner
Patna High Court Cr.Misc. No.7097 of 2016 (3) dt.11-04-2016 2/2 was done to death and the informant of the present case was accused in the case. He further submits that the petitioner had earlier approached this Court for grant of anticipatory bail and while dismissing the petition, certain observations were recorded by this Court vide Annexure-1 to the present petition. Moreover, he submits that there is general and omnibus allegation. In view of facts and circumstances, let the petitioner, namely, Chandrika Sahani be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in Muffasil P.S. Case no.185 of 2014.
