Admittedly, informant is not eye-witness of alleged occurrence and in course of investigation, not a single prosecution witness claimed to have seen the actual killing of the deceased. Moreover, having similar allegation co-accused Birbal Yadav has already been granted privilege of bail by this court vide order dated 29.1.2015 passed in Cr. Misc. no. 1292/2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl.
