The victim appeared before me in person and states that she has voluntarily solemnized her marriage with the petitioner and as a matter of fact, she had made her statement under section 164 of the Cr.P.C due to coercion by the police. She also states that a petition to the above stated effect has already been filed by her before the court below.

The medical report of victim reveals that she was aged about 17 years at the time of alleged occurrence but since the victim has already solemnized her marriage with petitioner and presently she has been residing in the house of the petitioner, I think it proper to release the petitioner on bail. Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.3305 of 2015 (7) dt.28-04-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria Narpatganj ( Ghurna) P.S.Case No. 254 of 2014.
