JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-09-2020 Heard the learned counsel for the petitioner and the learned counsel appearing for the State as also the learned counsel appearing for the respondent University. Initially the writ petition was filed for directing the respondent authorities to pay the post retirement benefits of the petitioner such as gratuity, provident fund, earned leave, group insurance etc.

The learned counsel for the petitioner has submitted that most of the retiral dues of the petitioner such as gratuity, leave encashment amount, portion of provident fund amount, group insurance amount etc. have been paid, however, subsisting grievances are as follows:-

The differential arrears on account of revision of pension for the period 23.09.2017 to 31.03.2019 is yet to be paid.

A portion of the provident fund amount pertaining to the period when the petitioner was posted as Principal, Ram Jaipal College, has not been paid to the petitioner.

No objection certificate with regard to a sum of Rs. 95,00,000/- (ninety five lakhs) paid to the petitioner while he was posted as Principal for the purposes of conducting various exams is yet to be issued to the petitioner.

Per contra, the learned counsel for the University submits that the Vice-Chancellor of the University would look into the matter and pass appropriate orders as also ensure redressal of the aforesaid subsisting grievances of the petitioner herein, if found tenable.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with a direction to the Vice-Chancellor, Jai Prakash University, Chapra to look into the aforesaid subsisting grievances of the petitioner and pass appropriate orders within a period of six weeks from today as also ensure payment of the outstanding amount, if found payable and further ensure issuance of no objection certification within the aforesaid time frame.
