Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 353, 307, 332, 333, 337, 427, 120B, 504, 506 of IPC and Sections 5 and 6 of the Sound Pollution Act and Section 9 of the Loud Speaker Act 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on eve of immersion of goddess Sarswati, the accused persons including the petitioner were playing loud music and dancing, thus were creating nuisance and when informant tried to stop them, the accused persons assaulted the police force causing injury.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that allegation of assault is general and omnibus in nature, i.e., no specific allegation of assault is alleged against the petitioner. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sigori P.S. Case No. 12 of 2023 subject to the conditions as laid down under Section 482 (2) of the BNSS. (Satyavrat Verma, J) Sumit/- U T
