1. Though the present writ petition has been filed for quashing the proceedings of the Encroachment Case No.16 of 2022-23, initiated by the Circle Officer, Purnea East, Purnea, however, at the outset, the learned counsel for the respondentState has submitted by referring to paragraph no.7 of the counter affidavit filed on behalf of the District Magistrate, Purnea on 11.11.2024 that the aforesaid encroachment proceedings have been dropped qua the petitioner, inasmuch as, during the course of verification conducted by the joint committee, it has transpired that earlier also encroachment proceeding was initiated vide Encroachment Case No.20 of 1995-96 and vide order dated
Patna High Court CWJC No.1264 of 2023(4) dt.12-11-2024 2/2 13.07.1995, the said proceeding was dropped, finding the petitioner to be the owner of the land/property in question.
2. In view of the aforesaid stand taken in paragraph no.7 of the counter affidavit, the learned counsel for the petitioner submits that if it be so, the petitioner is now not having any subsisting grievance.
3. Accordingly, the present writ petition stands disposed off.
