Smt. Kumari Amrita- Gp3 ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-09-2020 Due to COVID-19 Pandemic, the matter is being taken up by way of Virtual Court proceeding.

The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard the parties.

Following relief has been sought for in paragraph 1 of the present application on behalf of the petitioner:

Patna High Court CWJC No.18630 of 2018(4) dt.24-09-2020 2/3 "That this is an application for issuance of an appropriate writ(s)/order(s)/direction(s) in the nature of mandamus or any other appropriate writ(s)/order(s)/direction(s) for commanding the respondent authorities to make payment of due amount of General Provident Fund with statutory interest as well penal compound interest from the due date till the date of actual payment of the said amount to the petitioner, and further for payment of cost and compensation of harassment including other reliefs for which the petitioner is found entitled for."

A counter affidavit has been filed on behalf of the respondents. Following statements have been made in paragraph nos. 13, 14 and 15 of the counter affidavit:

"13. That it is respectfully been submitted that after receiving the application calculation was done and an authority slip for Rs. 1,15,792/- has issued vide office letter no. 401 dated 26.10.2018 with interest up to 1/2000.

14. That it is stated and submitted that after receiving the letter no. 3390 dated 27.06.2019 of Director, General Provident Fund, Patna regarding up to date interest another authority slip for Rs. 4,36,881/- has issued vide office letter no. 246 dated 22.07.2019 with up to date interest. Now, nothing is due for authorization.

15. That in view of the facts and circumstances stated above, now nothing is due for authorization from level of this respondent." It appears that most of the grievances of the petitioner has been redressed by the respondents. In case, if any further

Patna High Court CWJC No.18630 of 2018(4) dt.24-09-2020 3/3 grievance still remains to be redressed by the respondents, the petitioner will be at liberty to make representation before the competent authority who shall consider the representation of the petitioner and pass appropriate order in accordance with law within a period of four months from the date of filing of such representation.

With the aforesaid observation/direction, the present writ application stands disposed of.
