Petitioner is seeking anticipatory bail in connection with Baikunthpur P.S. Case No. 264 of 2018 registered for the offences punishable under Sections 153 (A), 295 and 506 of the Indian Penal Code and under Section 67 of the I.T. Act. Learned counsel for the petitioner submits that there is allegation against the petitioner that he had posted photo of Goddess Durga on Facebook with some bad comments. Learned counsel submits that the informant is a local leader of a particular party and has lodged the case only with an intention to get some publicity, this petitioner is a student and has never indulged in such act or omissions.

No.5292 of 2019(2) dt.14-02-2019 2/3 Learned counsel for the petitioner submits that in Paragraph 7 of the application, the petitioner has made a specific statement that the petitioner has no concern with the overt act and the concerned Facebook account does not belong to the petitioner.

Learned APP for the State is present and has opposed the prayer for bail.

In the given facts and circumstances considering that the petitioner has denied his connection with the Facebook post and that he is a student having no criminal antecedent, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Gopalganj, in connection with Baikunthpur P.S. Case No. 264 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C. One of the bailor would be the father of the petitioner who will take care that in future the petitioner is not involved in a similar kind
