2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 34 of the Indian Penal Code.
3. Petitioners are said to have snatched the briefcase, golden chain and other articles from the hand of the informant.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He submits that there is no specific overt act against the petitioners. He submits that there is general and omnibus allegation levelled against the petitioners. He submits that there is specific allegation against co-accused Sikandar Kumar and
Patna High Court CR. MISC. No.6269 of 2024(2) dt.22-02-2024 2/2 Akash Kumar. He further submits that petitioners have no criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State and learned counsel for the informant opposing the prayer for bail submit that the petitioners are also involved in the present case.
6. Considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioners on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Isuapur P.S. Case No. 160 of 2023.
7. However, if the petitioners surrender before the learned court below within a period of six weeks from today and pray for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.
