Petitioner Krishnamohan Pathak seeks bail in Bagaha Mahila P.S. Case No. 13 of 2014, registered for the offences punishable under Sections 323 and 376 of the Indian Penal Code.

The informant alleged that she was living with Krishnamohan Pathak, the petitioner, as concubine. The petitioner took Rs. 80,000/- from the informant for purchasing five Dhurs of land. When the informant demanded the money, the petitioner brutally assaulted her for that Bagaha P.S. Case No. 69 of 2013 was registered. The case was compromised. Again the informant started living with the petitioner but the petitioner demanded Rs. 50,000/- and drove her out from the house.

Considering the facts aforesaid, petitioner Krishnamohan Pathak is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha Mahila P.S. Case No. 13 of 2014. (Prabhat Kumar Jha, J.) Sanjay/- U T
