The petitioner seeks bail in Bhairav Sthan P.S. Case No. 108 of 2014, registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. The informant alleged that he came to know that battery of solar lights was stolen in previous night, on such enquiry was made and the battery was recovered from the possession of the petitioner and handle of hand pump was recovered from Naushad.

Learned counsel for the petitioner submits that no recovery was made from the possession of the petitioner. The case has been lodged at the instance of the Mukhiya only because of

Patna High Court Cr.Misc. No.4218 of 2015 (2) dt.02-02-2015 the petitioner was raising voice against illegal acts of Mukhiya. Considering the facts aforesaid and the fact that the petitioner has no criminal antecedent and he is in jail since 30.09.2014, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur (Madhubani) in connection with Bhairav Sthan P.S.
