JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 This application, for grant of anticipatory bail, arises out of Raniganj P.S. Case No. 150/18, disclosing offences under Sections 302/34 of the Indian Penal Code.

Petitioner no. 1 is mother -in- law, petitioner no. 2 is husband, petitioner no. 3 is sister - in- law of the deceased and petitioner no. 4 is the distant relative of petitioner no. 2 and the allegation against them is of causing death of the deceased. Submission of learned counsel for the petitioners is that no specific allegation has been attributed to the petitioners and in fact the deceased committed suicide by hanging herself. Moreover, except petitioner no. 2, all others are either in -laws or relative. Learned counsel for the State opposed the prayer for

Patna High Court Cr.Misc. No.4503 of 2019(3) dt.19-02-2019 2/2 bail.

Having heard both sides, considering the facts and circumstances of the case, so far petitioner nos. 1, 3 and 4 are concerned, in the event of their arrest or surrender before the court below within a period of six weeks are directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria, in connection with Raniganj P.S. Case No. 150/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. So far petitioner no. 2 is concerned, I am not inclined to grant the privilege of anticipatory bail to him rather he should surrender before the court below and make prayer for regular bail, which will be considered by the court below on the basis of materials available on record.

With the above observation and direction, this application is disposed of.
