JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Heard learned counsels for the petitioner and the State. This is an application for grant of bail to the petitioner in a case of misuse of bail.

Initially the case was registered for the offences punishable under Section 406 of the Indian Penal Code. The petitioner was granted bail on 1.3.1986. The bail bonds were cancelled on 24.5.1989 and right now the petitioner is languishing in custody since 16.7.2014.

It is submitted that the petitioner will regularly appear before the learned court below.

Considering the nature of accusation and the period in custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned

Patna High Court Cr.Misc. No.4634 of 2015 (2) dt.04-02-2015 2/2 SDJM, Sikrahana, East Champaran in connection with Tr. No. 4991 of 2014 arising out of Dhaka P.S. Case No. 126 of 1985. It goes without saying that the learned court below will be at liberty to cancel the bail bonds of the petitioner in case he defaults on two consecutive occasions.
