The petitioner is in custody in connection with Town P.S. Case No. 611 of 2018 for the offences under Sections 414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 31.08.2018. Referring to the prosecution case he submits that the allegation against the petitioner is that he was involved in theft of Motorcycle but his signature was not obtained on seizure list and seizure list was not prepared as per the mandatory provisions of Section 100 Cr.P.C..

Considering the aforesaid, the Court is inclined to

Patna High Court Cr.Misc. No.3840 of 2019(2) dt.25-01-2019 2/2 grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Town P.S.
