1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Harsidhi P.S. Case No. 448 of 2022 dated 11.09.2022 registered for the offences punishable under Sections 363, 366A read with Section 34 of the Indian Penal Code and Sections 8 and 10 of POCSO Act.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is a 18 years old boy while the victim is 19 years old as per medical board's opinion, in fact, there was love affair in between the petitioner and the so-called victim and the FIR was lodged by the victim's mother with malice intention but now a good relation has been restored in between them and the victim as well as her mother

Patna High Court CR. MISC. No.7693 of 2024(2) dt.19-02-2024 2/2 has filed a compromise petition before the trial court which has been annexed to this petition. Further submissions are that the petitioner has got fair and clean antecedent and against him, the investigation has been completed and he has been languishing in jail since 20.12.2023 and co-accused namely, Mukesh Kumar, has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 18.05.2023 passed in Cr. Misc. No. 72558 of 2022.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly taking into account the petitioner's young age as well as completion of the investigation against him, this Court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Harsidhi P.S. Case No. 448 of 2022.
