Petitioner seeks regular bail in connection with Kudhani PS Case No. 826/2021 registered for the offence punishable under Sections 272/273/34 of the IPC & under Section 30(a) of Bihar Prohibition & Excise Act. 765 litres of illicit liquor was recovered from Magic Vehicle bearing Registration No. BR31GA-0936. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is having no criminal antecedent. He next submits that the petitioner is neither the owner nor the driver of the said vehicle. No illicit liquor has been recovered from the possession of the petitioner. He is in custody since 11.11.2021. Regards being had to the submissions made by the

No.3542 of 2022(2) dt.25-05-2022 2/2 parties and taking into consideration the material on record and the fact that petitioner is neither the driver of the vehicle nor the owner of the same, no illicit liquor has been recovered from his conscious possession, petitioner having no criminal antecedent is in custody since 11.11.2021, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Kudhani PS Case No. 826/2021.
