Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Informant The statement of informant has been recorded u/S 164 of the Cr. P.C. in which, she stated that this petitioner called her and, thereafter, co-accused, Rabish and Mithilesh took her on a bike. Learned counsel, appearing for the petitioner submits that as a matter of fact, the victim was major at the time of alleged occurrence and she was in love with the petitioner and that is the reason, when this case was instituted, the petitioner and the victim both surrendered before the court below.

No.2417 of 2015 (2) dt.27-01-2015 Considering the aforesaid facts and circumstances as well as submission of the parties and also keeping in mind that the petitioner is in jail custody since 17-10-2014, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khagaria P.S.
