The petitioners apprehend their arrest in Dumaria P.S. Case No. 101 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and Sections 3/4 of the Witch Craft Act.

The informant named the petitioners and other accused persons and alleged that they all assaulted her with fists and slaps after calling her witch.

Learned counsel for the petitioners submits that petitioner no. 3 Sheo Kumar Yadav lodged Dumaria P.S. Case No. 100 of 2014 against the informant and others. Some scuffle took place on account of passage and land dispute.

Patna High Court Cr.Misc. No.3310 of 2015 (2) dt.27-01-2015 Having considered the facts aforesaid and the fact that there is case and counter case and the dispute arose due to land dispute and the informant got simple injuries, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sherghati at Gaya in connection with Dumaria P.S. Case No. 101 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
