The petitioner seeks bail in a case registered for the offences punishable under sections 406, 369, 302, 109 of the Indian Penal Code.
Originally, Suti P.S. Case No. 187 of 2009 was registered in the State of West Bengal on the basis of a complaint petition but subsequently, when it came to light that the deceased died under the jurisdiction of Singheshwar Police Station, the entire case record of Suti P.S. Case No. 187 of 2009 was sent to the learned Chief Judicial Magistrate, Madhepura, who, in turn, directed the Officer-in-charge of the concerned police station to
Patna High Court Cr.Misc. No.8273 of 2016 (2) dt.25-02-2016 register the first information report and investigate the matter. However, prior to institution of the present case, co-accused Hriday Das lodged a Sanha on 28.04.2009 in respect of the death of the deceased of the present case and in the said Sanha, he, specifically, stated that the deceased committed suicide. Moreover, the aforesaid co-accused and other, namely, Mithun Das has already been granted the privilege of bail by the coordinate Bench of this Court.
Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 74 of 2009.
