The petitioner seeks regular bail in S. Tr. No. 202 of 2014 arising out of Sasaram (Agrer) P.S. Case No. 1136 of 2013, registered for the offences punishable under Section 302 of the Indian Penal Code.

There is very specific allegation against the petitioner that Sanjay Kumar Singh was sitting in front of the house of Khalil Ansari. Arvind Ram, Ashok Ram who is relative of Arvind Ram and Dhanwati Kunwar were also sitting there. Some altercation took place on which Arvind Ram pierced sharpedged weapon in the abdomen of Sanjay Kumar Singh and he died.

Learned counsel for the petitioner has submitted that it is not a case of 302 of the Indian Penal Code. Some

Patna High Court Cr.Misc. No.2200 of 2015 (2) dt.19-01-2015 altercation took place and thereafter the petitioner is alleged to have given blow in the abdomen of the deceased. It is further submitted that petitioner does not appear to be of sane mind. There is specific allegation against the petitioner that he pierced sharp-edged weapon in the abdomen of Sanjay Kumar Singh who died.

Hence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

The trial court is directed to make efforts for conclusion of the trial within a period of one year from the date of receipt of this order.
