JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 The petitioner seeks regular bail in connection with Belhar P.S. Case No. 54 of 2019, registered for offences punishable under Sections 384, 506/34 of the Indian Penal Code.

Petitioner is not named in the F.I.R. and as per F.I.R., there is allegation that some miscreants came at the construction place of Baba Construction company and ask to stop the work till ransom is paid and they again threatened on mobile phone to not start the work and it appears that petitioner confessed about his participation in the occurrence. Apart from that petitioner is accused in three more cases.

It has been submitted on behalf of the petitioner that save and except confession, which has no evidentiary value in the eye of law, there is absolutely nothing against the petitioner

Patna High Court CR. MISC. No.6909 of 2020(2) dt.06-02-2020 2/2 and he has been in judicial custody since 08.04.2019. Heard learned A.P.P. also.

Having heard both sides, in view of the allegation as well as criminal antecedent of the petitioner, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the charge is framed, petitioner will be at liberty to renew his prayer for bail.

This application is accordingly dismissed.
