JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-06-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under section 323 of the I.P.C and sections 3, 4 and 5 of Prevention of Immoral Traffic Act.

The informant who is the wife of the petitioner alleged that the petitioner is indulged in immoral trafficking and in that business he is earning a lot, earlier also the informant acted as his associate but now she is opposing his act. Submission is of false implication and earlier the informant has filed a case bearing Complaint Case No. 28922 © of 2014 under sections 498 A and 323/34 of the I.P.C. wherein by

Patna High Court Cr.Misc. No.7753 of 2016 (4) dt.20-06-2016 2/2 order dated 24.09.2015 direction was issued not to take any coercive steps against the petitioner, in this case charge sheet has already been submitted and there is no chance of tampering with the prosecution evidence and the petitioner is in custody since 03.12.2015.

The learned A.P.P. fairly submits that the informant is wife of the petitioner.

In the facts and circumstances as stated above, now the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Aurangabad in Mahila Aurangabad P.S. Case No. 31 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
