2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 30 (a) and 40(i) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that altogether 3000 liters of spirit was recovered besides the road in 15 drums. It is also alleged that the petitioner fled away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner. It is further submitted that only allegation against the petitioner is that he

It is further submitted that the petitioner has been implicated in this case merely on suspicion. Learned counsel for the petitioner has further submitted that the petitioner is languishing in judicial custody since 10.12.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail and has submitted that the petitioner is having criminal antecedent of two cases.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Excise P.S. Case No. 317 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, East Champaran, Motihari, with a condition that the petitioner shall not indulge himself in similar nature of case in future.
