The petitioner seeks bail in anticipation of his arrest in connection with Buxar (Muffasil) P.S. Case No. 106/2019 dated 05.04.2019 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The house of one Manoj Singh was raided from where 855.360 litres of liquor were recovered. The petitioner has been named by the owner of the house, namely, Manoj Singh.

No.6982 of 2020(3) dt.10-06-2020 2/2 It has been submitted by learned counsel for the petitioner that petitioner is a person of clean antecedent and for inexplicable reasons, he has been named by the aforesaid Maonoj Singh. It has been urged that no offence under any one of the provisions of Excise Act can be said to have been made out against the petitioner.

Considering the aforesaid facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge -II, Buxar, in connection with Buxar (Muffasil) P.S. Case No. 106/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
