The petitioner seeks bail in POCSO 28 of 2014, arising out of Sadar Saharsa P.S. Case No. 843 of 2014, registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code.

Munni Devi the informant named the petitioner and other accused persons and alleged that they kidnapped her minor daughter Kajal Kumari for marriage.

It appears that the victim made her statement under Section 164 of the Cr.P.C. and she disclosed that Rahul Kumar, Pappu Bhagat and Bare Lal Bhagat took her to Purnea. Rahul Kumar committed rape with her. The victim did not disclose the name of the petitioner.

Patna High Court Cr.Misc. No.3319 of 2015 (2) dt.27-01-2015 Having considered the facts aforesaid and the fact that the victim did not disclose the name of the petitioner, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Ist Additional Sessions Judge), Saharsa in connection with POCSO 28 of 2014, arising out of Sadar Saharsa P.S.
