JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsel for the petitioner and the State. The petitioner being the step mother of the husband of the victim is languishing in custody since 21/11/2014 in a case registered for the offences punishable under Sections 302/34 and 328 of the Indian penal Code.
It is alleged by the maternal uncle of the victim that his niece has been administered poison after one month of the marriage.
It has been submitted that accusation has been levelled only on suspicion. The trial of co accused Jailal Pandit is going on in which the informant Bhagwat Pandit, father of accused Kamod Lal Pandit and the mother of the deceased have been examined as P.Ws. 5,3 and 7 but they have not supported the accusation. Patna High Court Cr.Misc. No.2678 of 2015 (2) dt.22-01-2015 2/2 further submitted that co accused Jailal Pandit has been granted bail by this court vide order dated 22/09/2014 passed in Cr. Misc. No.13352 of 2014.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheohar in Sheohar P.S.Case No. 127/2013.
