JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 This is an application for grant of anticipatory bail in connection with Ziradei P.S. Case No. 47 of 2018, disclosing offences under Sections 366(A) and 120(B) of the Indian Penal Code.

Allegation against the petitioners and other accused persons is of kidnapping the grand daughter of the informant for the purpose of marriage and it further appears from the statement of girl recorded under Section 164 Cr.P.C., which is Annexure-2, she named these petitioners.

Submission of learned counsel for the petitioners is that the statement under Section 164 Cr.P.C. of victim girl has been recorded four months of recovery and para 26 of the case diary clearly shows that she was recovered at Sitapur (U.P.) and

Patna High Court CR. MISC. No.5189 of 2019(3) dt.13-03-2019 2/2 handed over to the police and the petitioners have falsely been implicated in this case. Further, they have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, District Siwan, in connection with Ziradei P.S. Case No. 47 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
