The petitioner is apprehending his arrest in connection with Muffasil P.S.Case no.165/18 , registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code. Allegation against the petitioner is of dowry death, who happens to be husband.

Submission of the learned counsel for the petitioner is that the FIR itself shows that the petitioner is handicapped and due to that his wife did not want to live with him and she has committed suicide in her Maike itself and the false allegation of dowry as well as torture has been lodged against the petitioner. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,

Patna High Court Cr.Misc. No.4509 of 2019(2) dt.29-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri D. Singh, J.M. 1st class, Katihar in connection with Katihar Muffasil P.S.Case No.165 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
