Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.

The prosecution case as per F.I.R is that the financial irregularities were committed by the petitioner

No.18862 of 2021(2) dt.14-12-2021 2/3 being Mukhiya of Raj Siswa Sareya panchayat in collusion with the then panchayat Rojgar Sewak and Junior Engineer in respect of misappropriation of the government money sanctioned for soil filling work and bricks soiling on the road in village Manjharia under Scheme No. 05/2019. It is further alleged that the work was divided in two phases but the accused persons withdrew the government money without completing second phase of work.

It is submitted by learned counsel for the petitioner that on the order of the Additional Secretary, Rural Development Department, Government of Bihar, Patna, an enquiry was made by the State Quality Monitor in pursuance of the letter issued by the Additional Secretary, Rural Development Department addressed to the District Magistrate/Deputy Development Commissioner, West Champaran, Bettiah. The State Quality Monitor made spot inquiry and found the work completed.

No.18862 of 2021(2) dt.14-12-2021 3/3 In the facts and circumstance of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 200 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
