2. Counter affidavit has been filed.

3. The present application has been filed for the following reliefs:

"(a) For setting aside the notice dated 04/01/2024 issued under signature of Circle Officer, Khodawandpur, Begusarai in Land Encroachment Case No.-01/23-24 under Form-II, the petitioner for removal of encroachment within 14 days from the public land, which is completely without jurisdiction in view of the fact the house over piece of land upon Plot No.-1098 area 2.965 Decimal is since 120 years which is directly in the teeth of Bihar Public Land Encroachment Act 1956.

(b) Further restrain the Circle officer, Khodawandpur, Begusarai not to act pursuant to his notice dated 04/01/2024 passed in Land encroachment case No.- 01/23-24 till the disposal of the present writ application."

4. The grievance of the petitioner has been redressed.

5. The State has kept in abeyance the encroachment case in view of the status quo order passed in the Title Suit.

6. In view of the above, this application is disposed of.
