JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2015 Learned counsel for the petitioner is permitted to make necessary correction in prayer portion of the petition. Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since12/05/2014 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

It is alleged that a truck loaded with stone chips robbed along with mobile of the driver. Subsequently robbed mobile was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the recovery does not suggest that the petitioner participated in commission of the offence. The petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Bhagalpur in connection with Kahaalgaon P.S.Cse No. 232/2014.
