1. Though the present writ petition has been filed for staying the notice dated 29.09.2023 and 06.01.2024, issued by the Circle Officer, Hilsa, District-Nalanda, in connection with Encroachment Case No. 13 of 2023-24, however, the learned counsel for the respondent-State, upon instruction has submitted that the respondents are agreeable not only to grant an opportunity of hearing to the petitioner but also some time to him to produce the relevant documents in support of his right, title and interest over the land in question, whereafter the final order shall be passed by the Circle Officer, Hilsa, DistrictNalanda.

2. The learned counsel for the petitioner is not averse

Patna High Court CWJC No.2923 of 2024(3) dt.16-05-2024 2/2 to the aforesaid proposal put forth by the learned counsel for the respondent-State.

In view of the aforesaid, I deem it fit and proper to grant liberty to the petitioner to appear before the Circle Officer, Hilsa, District-Nalanda, in between 5th of June, 2024 and 18th of June, 2024, so that the petitioner can file his objections and documents in support of his case, whereafter the Circle Officer, Hilsa, District-Nalanda shall take the final decision, by passing a reasoned and a speaking order, in accordance with law, within a period of four weeks, thereafter and till then, status quo, existing as on today qua the land/house of the petitioner in question, shall be maintained.

4. The writ petition stands disposed off on the aforesaid terms.
