08-04-2016 Heard Sri Vikramdeo Singh, learned counsel who was assisted by Sri Pawan Kumar, learned counsel for the petitioner and Smt. Anita Kumari Singh, learned Addl. Public Prosecutor. The petitioner, who is in custody since 17-10-2015 as stated in paragraph - 10 of the petition in Gwalpara P.S. Case No. 95 of 2015 registered for the offence under Sections 25(1-B)A, 26 & 35 of the Arms Act, 1959, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner was falsely implicated in the present case, whereas, learned Addl. Public Prosecutor opposing the prayer for bail submits that from conscious possession of the petitioner, one country-made pistol alongwith eight live cartridges were recovered and the petitioner is also having criminal antecedents.

No.7003 of 2016 (3) dt.08-04-2016 2/2 However, keeping in view the nature of accusation and period of custody, let the petitioner namely Sanjeev Paswan @ Dara be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Uda-Kishunganj, District - Madhepura in Gwalpara P.S. Case No. 95 of 2015 on condition that one of the bailor must be blood relation of the petitioner and secondly, on each and every date the petitioner shall remain physically present before the court below. If continuously on two dates, the petitioner remains absent, without prior permission of the trial court, his bail-bond shall stand automatically cancelled. (Rakesh Kumar, J.) Anay U T
