1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Kotwali (Barari) Police Station Case No. 208 of 2024, dated 19.03.2024, disclosing offences under Sections 25(1-b)a/26 of the Arms Act.

3. The prosecution case, as per the First Information Report, is that on 18.03.2024, the police, on secret information that illegal arms were kept in the house of the co-accused Roushan Yadav, proceeded towards the place of occurrence. Upon seeing the police party one person started fleeing away from his house and was apprehended, who disclosed his name as Roushan Yadav.

Patna High Court CR. MISC. No.3429 of 2025(2) dt.29-01-2025 2/3 Upon search, the police recovered two country made pistols, along with magazines having three live cartridges, from the house of Roushan Yadav kept in an almirah.

4. Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report. He next submits that the petitioner has falsely been implicated in the present case on the basis of confessional statement of co-accussed Roushan Yadav. No incriminating article has been recovered from the premises belonging to the petitioner. He further submits that similarly situated co-accused Munna Prasad Yadav @ Munna Yadav has been granted anticipatory bail by this Court in Cr. Misc. No. 85016 of 2024.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated co-accused person has been granted anticipatory bail by this Court, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/-

No.3429 of 2025(2) dt.29-01-2025 3/3 (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Barari) Police Station Case No. 208 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
