JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Initially, petitioner was granted anticipatory bail by a co-ordinate Bench of this court vide order dated 07.10.2013 passed in Cr. Misc. No.33836 of 2013 with the condition that one of the sureties shall be an elected representative or a government servant belonging to that area.

Submission on behalf of the petitioner is that petitioner could not manage the bailor as per direction of this Court and in the meantime he was remanded in the present case on 20.07.2015 and since then he is languishing in jail custody. In the present case, except suspicion as well as

Patna High Court Cr.Misc. No.7206 of 2016 (2) dt.16-02-2016 2/2 criminal antecedent of the petitioner, there appears to be nothing against him.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Gaya in connection with Konch P.S.Case No. 72 of 2012.
