The petitioner in the present case is seeking regular bail in connection with Bikram P.S. Case No. 326 of 2019 registered under Sections 392 of the Indian Penal Code, pending in the court of learned Additional Chief Judicial Magistrate - VI at Danapur district - Patna.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case on the basis of confessional statement. The petitioner never went to the alleged Petrol Pump and he is in custody since 24.10.2019. Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein it has transpired in course of investigation that one of

No.2188 of 2020(2) dt.16-01-2020 2/2 the employees of the Petrol Pump has identified this petitioner and he being the eye witness, petitioner having been identified in a case of robbery, the period of custody being 24.10.2019 only, this court is not inclined to grant privilege of regular bail at his stage.

Prayer for regular bail of the petitioner is, thus, refused.

The petitioner may however renew his prayer for bail after a reasonable period.
