The petitioner seeks bail in Bidupur P.S. Case No. 295 of 2014 registered under section 307 and other allied sections of the Indian Penal Code.
The informant named seven persons in the first information report and alleged that the petitioner was armed with sickle.
Learned counsel for the petitioner submits that the informant of this case did not make any specific allegation against the petitioner. Abdhesh Kumar got one injury on the right side scalp and the injury was found to be grievous. Petitioner is in jail since the month of December, 2014.
On the other hand learned counsel for the
Patna High Court Cr.Misc. No.4304 of 2015 (3) dt.26-02-2015 2/2 informant as well as the A.P.P. alleged that during the course of investigation the witnesses have stated that it was the petitioner who assaulted the informant with sickle and the corresponding injury was found . The petitioner is alleged to have assaulted the informant on head and the injury found on the head of the informant is grievous. Hence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The petitioner may renew his prayer for bail after remaining six months in jail.
