JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-03-2019 The petitioner apprehends his arrest in connection with Town P.S.Case No. 266 of 2018 registered under Sections 120B, 409 and 420 of the Indian penal Code.

Allegation as per FIR is that scholarship amount to the tune of Rs. 2,02,16,335/-, which was to be distributed among the students of scheduled castes and scheduled tribes studying in different courses, has been misappropriated and on enquiry, it was found that same was sent to the Principal of Megasoft College of Management and Science, Aurangabad. It was also found that names of students studying in different courses were fake and it is alleged that Principal and Secretary of the college, the then District Welfare Officer, the petitioner and three clerical staffs namely Vijay Kumar and two others, in collusion, defaulcated the aforesaid amount.

No.4068 of 2019(3) dt.11-03-2019 2/2 Submission of learned counsel for the petitioner is that amounts were distributed on the list supplied by the Principal of the College and further bills were prepared by Vijay Kumar and petitioner is only Nazir and he has nothing to do with the affairs of distribution of scholarship and that Vijay Kumar has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 05.02.2019 passed in Cr.Misc. No. 6359 of 2019.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Town P.S. Case No. 266 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
