Patna High Court Cr.Misc. No.51966 of 2014 (3) dt.04-03-2015 2/3 CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-03-2015 In this case supplementary affidavit has been filed on behalf of Vijay Singh, petitioner in Cr. Misc. No. 3841 of 2015 which is kept on the record.
Heard the learned counsel for the petitioners as well as the learned A.P.P.
All the above mentioned three cases arise out of the same police station case and as such have been heard together and are being disposed of by passing this common order. The petitioners seek bail in a case for the offences punishable under sections 147, 148, 149, 427 and 302 of the I.P.C, section 27 of the Arms Act, sect 3⁄4 of DPPP Act, sections 3, 4 and 5 Explosive Substance Act, section 17 of the CLA Act and sections 10/20 UAPA Act.
The petitioner Vijay Singh is named in the F.I.R. whereas, other two petitioners are not named in the F.I.R. Submission on behalf of the petitioners is that they have more or less similar allegations in comparison with several other co-accused who have been granted privilege of bail by the coordinate Bench of this Court and so far petitioners are concerned they have been dragged in this case on account of
Patna High Court Cr.Misc. No.51966 of 2014 (3) dt.04-03-2015 3/3 enmity.
In the aforesaid facts and circumstances as stated above, as well as submission of the parties, the petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M. Daudnagar, DistrictAurangabad in Khudwan P.S. Case No. 47 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
