ANJANA PRAKASH ORAL ORDER 22-01-2015 Heard learned Counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 302, 304B, 498A, 341, 323 and 34 of the Indian Penal Code.
Considering that during Trial not even Informant has supported the case of the Prosecution and the Petitioner undertakes that he would be physically present on each date of Trial, let the petitioner above named, be released on bail on furnishing bail bond of Rs.5,000/-(Five thousand) with two sureties of the like amount each or any other surety to be fixed by the court concerned to the satisfaction of Adhoc Additional Sessions Judge-IV, Patna, in connection with Sessions Trial No. 12 of 2014 arising out of Patliputra P.S. Case No. 238 of 2013, subject to the conditions,
Patna High Court Cr.Misc. No.2486 of 2015 (2) dt.22-01-2015 2/2 (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner and the other shall be the aunt of the Petitioner namely, Rinki Devi. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner. (ii) That the Petitioner will be well physically present on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
In the meanwhile, the Trial Court (Adhoc Additional Sessions Judge-IV, Patna) is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order in connection with Sessions Trial No. 12 of 2014 arising out of Patliputra P.S. Case No. 238 of 2013, to the Superintendent of Police, Patna, and the Superintendent of Police, Patna, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
